Please read these Terms of Service (“Terms”) carefully before using bluecube.ai, including any portal areas made available through it (together, the “Service”).
1. Who We Are
The Service is operated by BlueCube AI B.V., a Dutch private limited company registered with the Dutch Chamber of Commerce (KVK) under number 97297801 (“BlueCube”, “we”, “us”, or “our”).
2. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
3. Scope: Website Use and Client Engagements
These Terms govern your use of the Service as a visitor or as a user of the portal areas we make available. Paid services, including AI engineering, analysis, training, platform licences, and support, are provided under separate written agreements between BlueCube and the client, such as a Master Services Agreement and its Order Forms. If there is a conflict between these Terms and such an agreement, the agreement prevails for the services it covers.
4. Accounts and Portal Access
Parts of the Service, such as our client portal, are available only with an account or access credentials issued by us. You are responsible for keeping your credentials confidential and for all activity under your account. Portal access is typically provided for the duration of an engagement and to the users designated by the client. We may suspend or revoke access where these Terms are breached, where an engagement has ended, or where we reasonably consider it necessary to protect the Service or its users.
5. Acceptable Use
You agree not to: (i) use the Service for any unlawful purpose or in violation of any applicable law; (ii) interfere with or disrupt the operation or security of the Service, or attempt to gain unauthorised access to it or to accounts of others; (iii) copy, modify, or create derivative works of the Service or its underlying software, or decompile, disassemble, or reverse engineer any part of it, except as permitted by law; or (iv) misrepresent your identity or affiliation when using the Service or submitting information through it.
6. Intellectual Property
The Service and its content, features, and functionality, excluding content submitted by you or your organisation, are and will remain the exclusive property of BlueCube and its licensors, protected by Dutch and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Nothing in these Terms transfers any of our intellectual property rights to you.
7. Your Content and Feedback
Content that you or your organisation submit through the Service, such as messages, notes, and materials shared in portal areas, remains yours. You grant us the right to host and process it as needed to operate the Service, respond to you, and provide the services concerned, and you are responsible for having the necessary rights to what you submit. If you provide suggestions or feedback about the Service, we may use it to improve our products and services without restriction or obligation to you.
8. Privacy
Personal data submitted through the Service, for example via our contact or request forms, is handled in accordance with our Privacy Policy and applicable data protection laws, including the GDPR.
9. Third-Party Services and Links
The Service may reference or link to third-party websites, tools, or services. These are governed by their own terms, and BlueCube is not responsible for their content, availability, or any limitations or changes in their terms or pricing.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, BlueCube disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted, and we do not guarantee specific outcomes from the use of the Service.
11. Limitation of Liability
To the extent permitted by applicable law, BlueCube shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any significant changes by posting the new Terms on this page and updating the date above.
13. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. In the event of any dispute between you and BlueCube relating to these Terms or the use of the Service, both parties will first attempt to resolve the dispute amicably. If an amicable settlement is not possible, the dispute shall be submitted to the competent Dutch court.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
